Rules for using RecallCheck

Eligibility

By accessing or using RecallCheck.net (the "Site"), you represent that you are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms. The Site is not intended for children under 13 years of age.

Description of the Site

RecallCheck is an informational, educational, and research platform that aggregates publicly available vehicle safety data from federal government sources. The Site provides tools including: VIN decoding, safety recall lookup, consumer complaint browsing, vehicle specifications, OBD-II diagnostic code reference, and vehicle safety data organized by make, model, and year. The Site is free to use and may be supported by advertising revenue from third-party ad networks, including Google AdSense. The Site is designed for informational and research purposes only. Information presented on the Site does not constitute professional automotive advice, legal advice, safety certification, or any form of professional recommendation. You should not rely solely on information from this Site when making decisions about vehicle purchases, repairs, or safety. Always consult with qualified automotive professionals, your vehicle dealer, or the vehicle manufacturer for the most current and accurate safety information specific to your vehicle.

Permitted Use and License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial, educational, journalistic, and research purposes. You agree NOT to: scrape, crawl, or use automated tools to extract data from the Site (except search engines respecting robots.txt); reverse engineer, decompile, or disassemble any part of the Site; overload, flood, or otherwise interfere with Site infrastructure; upload viruses, malware, or harmful code; send spam or unsolicited communications through the Site; attempt unauthorized access to any part of the Site; redistribute, republish, or create derivative works from Site content for commercial purposes; frame or mirror any part of the Site without written permission; use the Site to build a competing product or service; or attempt to access the Site's internal systems, databases, or server infrastructure through any means not intentionally made available through the Site. Violation of these restrictions may result in immediate termination of your access to the Site and may expose you to civil and criminal liability. We reserve the right to investigate and pursue legal action against anyone who violates these Terms, including seeking injunctive relief and monetary damages.

Data Sources, Accuracy, and Disclaimer of Warranties

RecallCheck aggregates data from the following public sources: National Highway Traffic Safety Administration (NHTSA), recall notices, consumer complaints, safety investigations, VIN decoding, crash test ratings; Environmental Protection Agency (EPA) and Department of Energy (DOE), fuel economy data; and SAE International, OBD-II diagnostic trouble codes (public standard).

THE SITE AND ALL CONTENT, DATA, AND INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TIMELINESS, OR NON-INFRINGEMENT. RecallCheck is not affiliated with, endorsed by, or sponsored by NHTSA, the U.S. Department of Transportation, EPA, DOE, SAE, or any vehicle manufacturer. Data may contain errors, omissions, or inconsistencies introduced during federal data collection, processing, aggregation, or our display of such data. Recall campaign information may not reflect the most current status of a recall, some recalls may have been completed, expanded, or modified after our last data update. Consumer complaints represent individual experiences and do not necessarily indicate a systematic defect. The number of complaints for a given vehicle does not alone establish the safety or reliability of that vehicle. VIN decoding results depend on the accuracy and completeness of NHTSA's Vehicle Product Information Catalog (vPIC) database. OBD-II diagnostic codes are standardized but their interpretation may vary by vehicle manufacturer. ALWAYS VERIFY CRITICAL SAFETY INFORMATION DIRECTLY WITH YOUR VEHICLE MANUFACTURER, AUTHORIZED DEALER, OR NHTSA (www.nhtsa.gov) BEFORE MAKING ANY DECISIONS RELATED TO VEHICLE SAFETY.

Intellectual Property Rights

The Site's design, layout, code, algorithms, organization, and presentation are the intellectual property of RecallCheck and are protected by copyright and other intellectual property laws. The underlying government data aggregated on the Site is in the public domain. However, our specific compilation, organization, analysis, and presentation of that data is copyrighted. You may not reproduce, distribute, or create derivative works from our proprietary content without written permission.

User Conduct

You agree not to use the Site for any unlawful, abusive, or fraudulent purpose; send spam or unsolicited communications; attempt commercial exploitation of Site content without authorization; impersonate any person or entity; interfere with or disrupt Site operations; upload viruses or malicious code; circumvent security measures; or scrape or harvest data through automated means (except search engines respecting robots.txt).

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RECALLCHECK AND ITS OWNERS, OPERATORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE. This includes, without limitation, damages for: loss of profits, data, or goodwill; site access issues or interruptions; errors or inaccuracies in data; decisions made based on Site information; unauthorized access to your data; or any third-party conduct on the Site. OUR MAXIMUM AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE TOTAL AMOUNT YOU PAID TO RECALLCHECK IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER. THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION OR CLAIMS IN THE AGGREGATE, INCLUDING WITHOUT LIMITATION BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATION, AND ANY OTHER TORT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

Indemnification

You agree to indemnify, defend, and hold harmless RecallCheck and its owners, operators, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: your use of the Site; your violation of these Terms; your violation of any applicable law or regulation; any damage you cause to a third party; your negligence or willful misconduct; or any content you submit, post, or transmit through the Site. RecallCheck reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims. You agree not to settle any such matter without the prior written consent of RecallCheck. RecallCheck will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

Third-Party Links and Advertising

The Site may contain links to third-party websites and may display advertisements from third-party ad networks (such as Google AdSense). These links and advertisements are provided for convenience and informational purposes only. RecallCheck does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party websites or advertisers. Your interactions with advertisers are solely between you and the advertiser.

Termination

We reserve the right to suspend or terminate your access to the Site at any time, for any reason, with or without notice. Upon termination, the following provisions survive: intellectual property rights, disclaimers of warranties, limitation of liability, indemnification, and dispute resolution.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the federal and state courts located in the jurisdiction where RecallCheck operates.

Dispute Resolution

Before filing any formal legal proceeding, you agree to first attempt to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute within 30 days. If informal resolution fails, either party may pursue formal legal proceedings as described in the Governing Law section. Nothing in this section prevents either party from seeking injunctive or equitable relief for intellectual property violations.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RecallCheck regarding your use of the Site. These Terms supersede all prior communications, agreements, and understandings, whether oral or written.

Force Majeure

RecallCheck shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, pandemics, government actions, cyberattacks, power outages, telecommunications failures, or third-party service provider failures.

Changes to These Terms

We may update these Terms at any time. Changes are effective when posted on this page with an updated "Last updated" date. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
