Tailgate struts failed within 2k miles of the 3/36k warranty. Even with the power back door feature "off", the struts are not simply converted to normal manual hydraulics. Each documented instance is after driving for a period of time (I note this to again document the vehicle is warm and not a cold start). During these drives the outside temperature drops and goes below 5 degrees during the drive at which point the vehicle begins having the sluggish acceleration and erratic RPMs. To reiterate and ensure it is clear. The vehicle is warmed up. It is not a cold start concern. I keep reiterating this because each time I raise the concern to Nissan and the dealer they simply say it is cold, this issue occurs after sufficient time for the vehicle to warm up. This is being raised to NHTSA because when it is happening the sluggish acceleration leads to general drivability issues, along with the erratic RPMs result in substantial loss of MPG. When it occurs gas mileage drops to generally about 8mpgs at best far below the rated MPG of the vehicle and normal driving characteristics.Read more

I notified Tesla legal of this problem (via certified mail) on October 13 2025 and requested a response within 14 days. The diagnostic code was P060A00 – “Internal Control Module Processor Performance.” Manufacturer documentation: Audi has previously issued Technical Service Bulletins 35-13-15 and 37-13-17, which identify this same defect as an internal circuit board failure and delamination in the DL501 mechatronic unit. The dealership only provided a “bill of sale” as proof of purchase. In addition, the seller offered a 30-day warranty for a transmission issue, which began showing problems again before the warranty expired. However, the dealership refuses to issue any refund, stating that it “does not make returns.” I believe this situation poses a risk to consumer safety, as the vehicle was sold without a valid title and with a significant mechanical issue that could affect its operation. This is extremely dangerous and could easily lead to an accident. I’m very concerned that the safety features intended to protect me could instead cause harm. The airbag warning appearing and disappearing daily raises fears that the airbags could deploy unexpectedly, especially since service technicians cannot reproduce the warnings. In addition, the vehicle has been in the shop three times this year for what sounds like an exhaust leak, but no issue has been found.
