... an indoor temperature exceeding 104 degrees fahrenheit. Despite all attempts to override the system, the car remained locked, and the battery dead, and emergency services had to be contacted. Officers from the Santa Barbara Sheriff’s Department, California Highway Patrol, and Montecito Fire Department arrived on scene and, in order to rescue my baby, were forced to smash a window to gain entry. The police officer was advised by a Tesla representative to do so, as he confirmed there would be no way to override the system to open the doors. My baby was found screaming in a pool full of sweat and was carried to an ambulance, where the paramedic warned me of concerning vital signs and advised me to go to the Santa Barbara Cottage Hospital to have his condition assessed and treated, if necessary. I have obtained a copy of the police report (Case No. XXX) and will provide it upon request. Tesla confirmed that this problem with the 12V battery is common, nonetheless we were made to pay for a new window and a battery replacement. Shortly after having the computer updated to stop it from spontaneously catching fire I have been getting a warning light saying to maintenance the hybrid system, and is accompanied with a momentary loss of propulsion. This happens without warning every 150 miles or so. The dealership said it had a ‘digital crash’ code and was not able to reproduce, but I have video evidence of the warning lamp coming on and then clearing itself. There is now a safety recall issued for this exact problem with no fix available at this time. There are no warning lamps in advance of these issues occurring, only concurrent to the issue happening. I do not feel safe driving this vehicle. Past experience tells me I could lose propulsion and/or steering at any time. ... error code. The Code points to a leak within the brake actuator system. Upon research I have found that this is a very common and costly repair that Toyota has known about for many years. Toyota issued a customer support program related to this issue that ran for 10 years or 150,000 miles from the vehicle's date of first use. This car, being a 2012, is beyond the support program. I contacted Toyota, hoping they would do the right thing and cover the repair. I was told that they would not cover the repair or supply the parts to cover the repair. I told the Rep. for Toyota that I did not feel like it was fair for Toyota to continue to put millions of drivers at risk for a product that they clearly realize for years now is defective and could hurt or kill someone. The code and the braking issue did not appear until after the customer support program ended and therefore we had no warning or way to anticipate this braking issue or the danger to my daughter and anyone else riding with her in the car or on the roadway near her travel routes. I traveled 300 miles, rented a Uhaul car tow trailer and brought the car back home. My mechanic confirmed the code C1391 and the fact that the brake actuator has failed. The mechanic has ordered the parts (the same defective parts) to replace the broken ones. Toyota is still selling the same part as a replacement part clearly knowing that it is not safe and no warning came with the replacement part explaining the potential for a braking issue. This situation puts me and other drivers at risk, as the unresolved recall issues directly affect vehicle safety. I kindly ask NHTSA to review this case and provide guidance on ensuring that recall obligations are respected internationally, or to instruct Audi AG / Audi of America to facilitate the execution of these recalls regardless of the vehicle’s current market.
