Description of Incident: On February 9, 2026, at approximately 3:00 PM, I was driving my 2021 Kia Soul on Calvine Road and Winterberry in Elk Grove, CA. A vehicle suddenly merged into my path. I immediately attempted to apply the brakes, but the pedal failed to depress or engage normally. Despite the imminent collision, the Forward Collision-Avoidance Assist (FCA) failed to provide any alert, and
... the Automatic Emergency Braking (AEB) system did not activate. To avoid a high-speed, rear-end collision, I was forced to perform an emergency steering maneuver toward the curb and into roadside bushes to stop the vehicle. This maneuver resulted in severe mechanical failure, including a broken driver-side axle, damaged rims, and broken brake pads. The dealership (Elk Grove Kia) has provided an estimate of $9,461.67 for these repairs but has failed to explain why the primary safety systems and service brakes failed to function as designed during this emergency.Read more

I am the owner of a 2025 Toyota Sienna currently grounded at an authorized dealership due to safety recall NHTSA #25V668 (improperly welded 2nd-row seat rails) and I suspect NHTSA #25V099 (3rd-row seat back bolts) also may apply (but has not been tested). As of today, the vehicle has been out of service for nearly 60 consecutive days. The dealer confirmed the defects but stated that no remedy is a
... vailable and no timeline for repair has been provided by the manufacturer. This defect poses an extreme safety risk. I have an infant in a car seat; Toyota’s interim guidance (which prohibits use of the 2nd row) makes it impossible to safely transport my child. Using the 3rd row is not a viable or safe alternative for an infant in a rear-facing seat. Toyota has failed to provide a remedy within a "reasonable time" per 49 U.S.C. § 30120. Under California’s Song-Beverly Act, the 30-day "out of service" threshold has been exceeded. Because the manufacturer cannot fulfill its warranty and safety obligations, I am formally seeking a vehicle replacement (Substitution of Collateral).Read more

On December 27, 2025, at approximately 150,556 miles, my 2015 Kia Optima Hybrid experienced sudden engine knocking, power loss, and failure while driving at 65 mph on a highway. The vehicle dropped into limp mode and I had to pull off the highway. The car required towing to the dealership as it would not drive safely. Diagnostics revealed a knock sensor error (P1326 code) and failing connecting ro
... d bearings via Bearing Clearance Test, consistent with the known Theta II engine defect (manufacturing debris causing oil starvation and premature bearing wear). This follows earlier symptoms: Intermittent 'Check Hybrid System' warnings in early December 2025 at 148,665 miles (dealership unable to reproduce, but historical codes noted). The Knock Sensor Detection System (KSDS) software update was performed in February 2022 during prior CHS warnings. Despite onset of issues under the 150,000-mile extended warranty limit per the Kia E2 Settlement, Kia denied coverage due to the minor mileage overage and directed me in a loop between Consumer Assistance and the Settlement Administrator. The defect poses a serious safety risk: potential for sudden engine seizure, stalling while driving, or engine compartment fire (as seen in related Theta II recalls and thousands of NHTSA complaints). No crash, injury, or fire occurred in my case, but the failure left the vehicle undrivable and unsafe on the road. I have service records and diagnostic reports to support this.Read more

A failing alternator caused me to take my kia into a mechanic for OEM replacement. The mechanic informed me that the engine rattles. I got to talking with the mechanic and told him that my car has been experiencing high oil consumption with no 'low oil' warning light on the dash and ive checked my oil periodically between changes and have found the dip stick bone dry multiple times. A year later,
... my alternator failed AGAIN and was replaced with another OEM part. The same mechanic told me that the engine is still rattling (i hadnt gotten it fixed/diagnosed because i am low income) and that he found out there had been a recall for Kia Sotento engines with my vehicle date range. Upon research, I find thousands of people on different platforms are also experiencing high oil consumption and there was actually a recall. When I checked my VIN, my vehicle was NOT part of the recall. There seems to be a high number of consumers who have the SAME issue, but are also NOT included in the original recall and we are all being told that unless we pay for a new engine out of pocket, there's NOTHING that can be done. High oil consumption with NO warning light is DANGEROUS. How is it possible that only HALF of the vehicles with the SAME defect are eligible for a recall/repair and the rest of us are S.O.L? I am the second owner of this vehicle and purchased from a used lot, however Kia knew about this defect before I purchased the vehicle from the used lot. The used car dealership no longer exists so I can't even ask them if Kia made them aware (which they potentially did not since my VIN isn't considered eligible anyways) This issue needs to be rectified for the thousands of consumers/customers that are experiencing this problem and I strongly suggest a new investigation be conducted for the remaining vehicles that were manufactured in the same time frame as the vehicles that ARE covered. My vehicle has only 90K miles on it!Read more
