I DRIVE A 2002 INFINITI I35 I WAS INVOLVED IN A CLASSIC T-BONE COLLISION THE FRONT END OF MY VEHICLE TOTALLY DESTROYED AND BOTH VEHICLES WERE TOTALED. THE INVESTIGATOR CLAIMED THAT THE SENSORS DETECTED THE SAFETY BELT WAS IN PROPER USE THEREFORE MY AIRBAG DID NOT NEED TO BE DEPLOYED AND SINCE MY PASSENGER SEAT BELT WAS NOT ENGAGED THAT IT DEPLOYED AS A CAUTIONARY MEASURE. MY RESPONSE WAS TO INSIST ON THE 2002 I35 AIRBAG SAFETY DOCUMENT. IT WAS FORWARDED 4 DAYS LATER WITH STRIKING DIFFERENCES, NAMELY THAT THERE ARE NO SENSORS IN THE INTERIOR CABIN OF THE 2002 MODEL AS STATED BY THE NISSAN/INFINITI INVESTIGATOR. I ASKED IF THERE WERE NO SENSORS OTHER THAN THE ONES IN THE BUMPER ON MY 2002 MODEL HOW THEN DID THE COMMUNICATION OCCUR IN MY SEAT BELT THAT CAUSED MY AIRBAG TO NOT DEPLOY AND THE PASSENGER AIRBAG TO DEPLOY. WHEN HER REPORT WAS CHALLENGED SHE SAID HER ASSESSMENT WAS ACCURATE AND SHE WAS STANDING BY IT. SHE HAS NOT PHYSICALLY EXAMINED MY VEHICLE TO DETERMINE CAUSATION OF THE FAILED AIRBAG DEPLOYMENT. I BELIEVE THAT THE AIRBAG IS DEFECTIVE I WAS TRAVELING 35 MPH, THERE WAS NO SKID PRIOR TO IMPACT BOTH VEHICLES TRAVELED AN ADDITIONAL 20 FT. FROM IMPACT POINT. ... IN WEEKS OF PURCHASING THE VEHICLE I TOOK IT BACK TO THE INFINITY OF KIRKLAND DEALERSHIP WHERE WE HAD PURCHASED IT. THEY UNDERSTOOD THE PROBLEM AND MENTIONED THAT OTHER OWNERS HAD BROUGHT THIS MODEL IN FOR THE SAME PROBLEM. THE DEALERSHIP MENTIONED THAT WHEN THEY BROUGHT IT TO THE ATTENTION OF THE MANUFACTURER THAT THEY STATED IT WAS A REGIONAL ROAD CONDITION ISSUE AND THEY WOULD NOT BE RESPONSIBLE FOR A REPAIR OR ALTERATION. I TOLD THE DEALERSHIP THAT A RENTAL VW RABBIT DID NOT SHOW SIMILAR SIGNS OF A JERKING MOTION WHEN TRAVELING THE SAME ROADS. THE DEALERSHIP UNDERSTOOD AND AGREED THAT OTHER MODELS IN THE INFINITY LINE DON'T HAVE THIS ISSUE. THE DEALERSHIP WENT ON TO SAY THAT SOME OF THE OTHER OWNERS HAD FILLED COMPLAINTS WITH THE FTC AND DID IN FACT FINALLY GET A SOME RESOLUTION FROM THE MANUFACTURER. WE HAVE RECENTLY FILED A COMPLAINT WITH THE FTC. IN JUST THOSE CASES WHERE COMPLAINTS WERE FILED, THE MANUFACTURER REPLACED THE BRAND OF TIRES THAT WERE INSTALLED IN THE VEHICLE AND FOR THE MOST PART REPAIRED THE ISSUE. THIS "REPAIR" WAS ONLY DONE WHEN THE MANUFACTURER WAS FORCED TO DO SO. THIS SEEMS NOT ONLY UNFAIR TO ALL THE OTHER OWNERS BUT IRRESPONSIBLE OF THE MANUFACTURER. MY WIFE AND I BELIEVE THIS TO BE EXTREMELY UNSAFE AND ARE SURPRISED THAT THIS CONDITION HAS NOT ALREADY HIT THE NEWS CAUSE ACCIDENTS AND POTENTIAL DEATHS. IN JUNE 2009, I TOOK MY 1998 INFINITI I30T INTO A DEALERSHIP FOR A ROUTINE SERVICE. THE DEALERSHIP NOTIFIED ME THAT MY VEHICLE WAS UNSAFE TO DRIVE BECAUSE THE FRAME HAD ROTTED UNDER THE ENGINE & HAD DISCONNECTED FROM THE BODY. HE THEN INFORMED ME THAT CONTINUED OPERATION COULD RESULT IN THE FRAME COMPLETELY SPLITTING APART CAUSING THE ENGINE AND TRANSMISSION TO FALL OUT OF THE VEHICLE, WHICH COULD
... THEN TRIGGER A SERIOUS M/V ACCIDENT. I WAS ALSO INFORMED THAT THE VEHICLE WOULD NO LONGER PASS THE YEARLY STATE INSPECTION. I ADVISED THE SERVICE MANAGER TO FIX THE PROBLEM. HE INFORMED ME THAT THERE WAS NO WAY TO CORRECT THE DEFECT. THERE WAS NO REPLACEMENT PART OR WAY TO WELD THE PIECES TOGETHER. I WENT TO KELLY INFINITI AND SPOKE TO THE SERVICE MANAGER, WHO ADVISED ME THERE WERE NO OPEN RECALLS FOR FRAMES IN THESE VEHICLES. HE WENT ON TO STATE THAT HE HAS HEARD OF THIS PROBLEM IN SIMILAR VEHICLES AND BELIEVED THE KELLY COLLISION CENTER COULD POSSIBLY REPAIR THE PROBLEM. WHEN ASKED HOW AN AVERAGE CONSUMER WOULD IDENTIFY AND KNOW TO CORRECT THIS PROBLEM, HE ADVISED THAT THE FRAME IS CHECKED ON A VEHICLE'S YEARLY INSPECTION. MY VEHICLE HAD JUST BEEN INSPECTED IN OCTOBER 2008 AND THERE WAS NO INDICATION THAT THERE WAS AN ISSUE WITH THE FRAME. HAD I NOT GONE IN FOR SERVICE IN JUNE, MY NEXT INSPECTION WAS IN OCTOBER 2009, A FULL FOUR MONTHS LATER. WHAT WOULD HAVE HAPPENED HAD MY 17 YEAR OLD SON HIT A POT HOLE ON A HIGHWAY GOING 55 OR 65 MPH AND THE VEHICLE SPLIT APART AND/OR THE ENGINE FELL OUT? A FATALITY IS CLEARLY A POSSIBILITY. I WENT TO KELLY COLLISION CENTER IN BEVERLY AND MET WITH MANAGER SKIP GIRARD, WHO ADVISED ME HE COULD CORRECT THE PROBLEM, AS HE HAD DONE WITH SEVERAL OTHER 96 AND 97 I30'S. HE STATED THAT MY I30 WAS THE FIRST 1998 THAT HE HAD SEEN WITH THIS FRAME ROT. HE ADVISED THAT THE VEHICLE'S DESIGN CAUSES WATER FROM THE ROAD OR RAIN TO CONTINUOUSLY SATURATE THE FRAME IN THIS AREA, WHICH CAUSES CORROSION.
