On 6/9/2024 I was driving, while entering a tunnel, and using the adaptive cruise, the car did not track the car in front of me. I braked, this did not stop the adaptive cruise (according to Subaru) and the car collided with the car in front of me after the emergency braking system failed to also stop the car in time. Starling did not call to check on us for 30 minutes (did alert 911) but no call was made to my phone, as per the paid service, and the airbag exploded and we were covered in brown substance. I have a 2016 Kia soul. Second owner. 144,000+ miles. For nearly a year my car has been consuming oil at an alarming rate. But I have no oil leaks anywhere. If I go to speed up past 60mph, the car forcibly bogs down to 45mph and struggles to get back up to speed. The vehicle was shaking, knocking, and struggling with performance. I drove the car to a small town and checked my oil. Bone dry. So I top it off with a couple quarts. I drove the car to a non Kia dealership where a mechanic told me my car was misfiring. He popped the hood and for the first time, my engine was knocking back and forth. It’s never done that. He said that he felt confident there was rod damage and drove it around the block. When he returned he said it was not safe to drive and I had it towed to the closest dealership over an hour away. The dealership felt extremely confident that my car was going to qualify for the motor swap warranty that Kia offers up to 150,000 miles or 15 years. Keep in mind, my car NEVER once threw a check engine light during any of these occurrences, nor did a low oil light ever come on in the 4 years I owned the vehicle. But under different circumstances, such as being roadside, this could have been a very unsafe situation. This is the original battery. Fuel tank has expanded to the point that my vehicle is deemed not safe to drive. As pressure in the tank is unable to be stabilized. Only had the car for about 70 days since the date of purchase. Repairs are about $3900. In short as told by the dealership service department, my car could blow up at any time. This is not safe, at all.

The independent mechanic made the contact aware of Customer Satisfaction Program: 21N12. The vehicle was then taken to a dealer where it was diagnosed; however, the vehicle could not be repaired under the Customer Satisfaction Program, because the vehicle was leaking oil instead of coolant. The vehicle was not repaired. The manufacturer was made aware of the failure and referred the contact to the NHTSA Hotline to report the failure.
