I WAS DRIVING MY HONDA ODYSSEY EX 2004 IN THE LEFT MOST LANE WITH MY WIFE AND 3 KIDS (AGES 7, 10, 12) ON A HIGHWAY AT 70 MPH. IT ALMOST FELT LIKE THE ELECTRONICS WERE TRYING TO DECIDE WHETHER IT SHOULD STAY IN 5TH OR SHIFT BACK TO 4TH BECAUSE OF LOW RPM'S. IT WOULD HAPPEN WITH AN EXTREMELY LIGHT ACCELERATOR PRESSURE. THE MANNER THAT THE CAR BEHAVES CAN REALLY CAUSE AN ACCIDENT WITH THE SURGE IN THE TRANSMISSION, & THE DISTRACTION THAT IT CAUSES TO THE DRIVER. I RECEIVED THE CAR BACK, & WAS TOLD THAT THE SOFTWARE WAS UPGRADED, & TO TAKE THE VEHICLE AND SEE HOW IT DROVE. I DROVE THE VEHICLE HOME, & THE ISSUE WAS STILL THERE. THE REPAIR INVOICE SAYS THE SOFTWARE WAS NOT UPDATED. IT ALREADY HAD THE LATEST VERSION. I TOOK THE CAR BACK, AND THEY STATED THE OPERATION OF THE CAR IS NORMAL. IT IS NOT NORMAL. IN AN INCIDENT WHEN DECELERATING FROM TOP GEAR TO 10 MPH OR LESS AND THEN IMMEDIATELY ATTEMPTING TO ACCELERATE, THE CAR TAKES ABOUT 4 SECONDS TO BEGIN TO RESPOND. ONCE I DEMONSTRATED IT TO THE DEALERSHIP THEY LOOKED INTO IT FURTHER. BMW'S RESPONSE WAS "THE VEHICLE IS OPERATING AS DESIGNED." FURTHER COMPLAINTS RESULTED IN "CUSTOM SOFTWARE" FOR THE TRANSMISSION WHICH DROPPED THE DELAY FROM ABOUT 4 SECONDS TO ABOUT 3.75 SECONDS, AND ALLOWED THE TRANSMISSION TO TRANSFER SOME POWER TO THE WHEELS AS IT WAS WORKING DOWN THE GEARS. IT WAS AN EXTREMELY LIMITED IMPROVEMENT, STILL FAR FROM SAFE. A FOUR SECOND DELAY BEFORE A DRIVER CAN MOVE THE CAR EFFECTIVELY AFTER BREAKING IS UNSAFE. I AM FORTUNATE IN THAT I DISCOVERED THIS PROBLEM IN A SITUATION WHERE I WANTED TO ACCELERATE, BUT DIDN'T HAVE TO, IN ORDER TO AVOID A COLLISION. HAD THIS HAPPENED ON THE 75 MPH FREEWAYS IN IDAHO WHERE I LIVE, I COULD EASILY BEEN HURT OR KILLED. THIS WAS REPORTED TO THE DEALERSHIP, AND BMW NORTH AMERICA. AFTER LETTING THE CAR SIT FOR A COUPLE OF HOURS WE MOVED IT TO A SECURE LOCATION TWO MILES AWAY. DURING THAT DRIVE ALL OF THE ABOVE PROBLEMS HAPPENED AGAIN, INCLUDING THE ENGINE BEING "STUCK" IN SECOND GEAR. AFTER LETTING THE CAR SIT OVERNIGHT, IT STARTED AND RAN WITHOUT INCIDENT. THE FORD FUSION SE V6 WITH AUTOMATIC GIVES THE CHOICE OF FIRST, WHICH REDLINES AT ABOUT 35 MPH, OR DRIVE, WHICH WILL SHIFT TO 6TH GEAR EVEN ON THE LEVEL AT 35MPH. ... RIAN CROSSING AND A SPEED LIMIT OF 15 MPH. I PULLED OFF TO THE PARKING LOT AT TOWER FALLS AND THE SMELL OF HOT BRAKES WAS EVERYWHERE. THE VEHICLE'S WHEELS WERE HOT. IF THE BRAKES HAD FADED, I WOULD HAVE HIT THE PEDESTRIAN CROSSING AT HIGH SPEED UNLESS I FOUND A NICE ROCK WALL TO RUN INTO INSTEAD. THE VEHICLE DESPERATELY NEEDS ENGINE BRAKING. I TALKED TO HYUNDAI CUSTOMER SERVICE WHEN I HAD THE CAR IN FOR SERVICE AND THE DEALER COULD FIND NOTHING WRONG - THEY OFFER NO HELP - THE OLD - IF IT DOES NOT REGISTER A CODE ON THE COMPUTER OR UNLESS THE DEALER CAN DUPLICATE THE PROBLEM - WE WILL NOT DO ANYTHING. WE PURCHASED A 2004 FORD FREESTAR LIMITED MINI-VAN WITH 36,000 MILES IN JUNE 2007 FROM THE LOCAL FORD DEALERSHIP. THREE MONTHS LATER WHILE DRIVING ON THE INTERSTATE HEADED FOR VACATION, THE VAN LOST POWER WITHOUT WARNING AND WE COASTED TO A STOP ON THE SHOULDER OF THE HIGHWAY. OWNED FOR APPROXIMATELY 3 MONTHS, JUST OVER 36,000 MILES, TWO SMALL CHILDREN IN THE VAN TRAVELING AT CLOSE TO 70MPH AND PACKED WITH LUGGAGE FOR A FAMILY VACATION...ALL I CAN SAY IS I WAS VERY DISAPPOINTED. FORD DID PAY FOR HALF THE COST, HOWEVER, I STILL PAID $1,500 OUT OF POCKET TO FIX THE TRANSMISSION, $ FOR TOWING, AND $ TO RENT ANOTHER VAN WHILE THIS ONE WAS BEING FIXED. FORD TOLD ME THAT THE 3 YEAR WARRANTY HAD ALREADY EXPIRED. WE STILL OWN THE VAN AND HAVE HAD MANY OTHER PROBLEMS, OF WHICH SOME ARE STILL NOT FIXED. WE ARE NOW CLOSING IN ON 70,000 MILES AND I'M VERY CONCERNED THAT WE WILL SOON EXPERIENCE ANOTHER TRANSMISSION PROBLEM.
